Terms of service
These terms are between [Company name], [registered address] ("we", "us") and the person or business that creates an Unagi account ("you"). By creating an account you agree to them and to our privacy policy. If you are using Unagi for a business, you confirm you can bind it.
1. The service
Unagi provides website analytics: a script you add to your sites, a crawler that maps the pages of sites you control, and a dashboard that reports findings. We may improve, change or remove features. We will give reasonable notice of changes that significantly reduce the service.
2. Trial and plans
New accounts receive a free trial of 14 days. No payment details are taken and nothing is charged automatically. When the trial ends, collection and reports pause and your data is retained until you delete it or we agree a plan with you. We will agree any price with you in writing before any charge.
3. Your account
Keep your password secure and tell us promptly of any unauthorised use. You are responsible for activity on your account. You must give accurate information.
4. What you must do
- Only add domains you control. You must prove control before we crawl a site. Do not try to bypass verification.
- Be lawful with visitor data. You are the controller of your visitors' data. You must have a privacy notice that covers Unagi, obtain any consent the law requires before calling
Unagi.consent(true), and honour visitors' rights requests. Our data processing addendum applies. - Use the chat and email honestly. Only offer discounts you will honour and create the codes in your own shop. Do not use the assistant for false urgency, false scarcity or pressure, and send marketing email only to people who agreed to receive it. You are responsible for the content of promotions you send. We may suspend sending that breaches these rules or the law.
- You decide what to collect, and you answer for it. Location, IP address and phone number are options you switch on. Tell your visitors in your own privacy notice what you collect and why, collect only what you need for a stated purpose, and honour requests to erase or access data. Never use the tool to track people who have not agreed to tracking.
- Do not send sensitive or unnecessary data. Do not send payment details, passwords, health data, other special-category data, or personal identifiers such as names or emails, in event properties.
5. What you must not do
- Use the service to track people in breach of the law or against their choices.
- Probe, scan or test the security of the service without our written permission, or overload it.
- Use the crawler or service to collect data from sites that are not yours.
- Resell or sublicense the service without our agreement.
- Interfere with other customers' use of the service.
We may suspend an account that breaches these terms or puts the service or others at risk, and will tell you why where we can.
6. Your data and ours
You keep all rights in the data collected from your sites. You give us permission to process it to provide the service. We keep all rights in the Unagi software, design and name. We may use data that cannot identify you or your visitors (for example, aggregate statistics about service usage) to operate and improve the service.
7. Findings are estimates
Unagi's findings are calculated from the traffic your site records and are estimates. Small samples, blocked scripts and visitors who decline tracking all affect accuracy. Findings are information, not advice, and we do not guarantee any commercial result from acting on them.
8. Availability and support
We aim to keep the service running but do not promise uninterrupted availability. During the trial it is provided as is. Email us for support.
9. Liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud. Subject to that: we are not liable for indirect or consequential loss, loss of profit, revenue or data, or loss of business opportunity; and our total liability to you arising from the service in any 12-month period is limited to the amount you paid us in that period, or £100 if you have paid nothing.
10. Ending the relationship
You can stop at any time and delete your account from the Account page, which removes your data. We may end the service or your account on 30 days' notice, or immediately for serious breach.
11. Changes to these terms
We may update these terms. If a change is material we will tell you before it takes effect, and you can close your account if you do not agree.
12. General
These terms and the documents they refer to are the whole agreement between us about the service. If a part is unenforceable the rest continues. These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction, except where consumer law gives you the right to use your local courts.
